Legal Question in Civil Litigation in California

Car repo.

Ive recently fallen into financial problems due to child support payments which have affected my ability to stay current with some of my bills.I applied for financial assistance from a foundation,and they paid my car note for me to bring it to current ..The payment was mailed to them 0n 2/22/07. I called that day to inform them that the payment was sent.Last night they had the car picked up from in front of my house without any regards to the information about the payment being sent.This has caused me major problems and now they are telling me that i have to pay the entire balance which to get the car back...Can i fight it ?

You should contact an the union and to determine whether the check sent to the lender was cashed. There are statutory requirements that must be followed by the lender before the car is repossessed. Contact attorney with experience in the area of automobile financing regarding this matter. Take all correspondence you have received from the lender with you to the conference.
