Legal Question in Civil Litigation in California

Car stolen from parking garage, are they liable??

My car was stolen from the lot my company employs for parking, paying $100. per month, per employee. There is no agreement in writing with the parking company, only a verbal agreement. On the back of the parking passes issued by the parking company is the standard 'This contract limits our liability-Read it'. The police recovered my car (I do not have theft insurance, only liability), and I have gotten it repaired. The parking company refuses to pay for damages of aprox $2000.00. My employer wants to stay out of it so we don't lose our parking arrangement. What kind of a case do I have for small claims? Are there other cases I can site in my favor? I am a single mother trying to make ends meet, the money I have spent, and property lost is not a huge sum of money, but it is a lot to me.

You can take into small Claims Court and see what happens. Youll have to convince the judge that they were in some way negligent and that their negligence caused the theft. Negligence is determined on a case-by-case basis depending on what the individual facts are.
