Legal Question in Civil Litigation in California
Do I have a case, and if so what should I press charges for?
The incident happened less than half a block of my home at a 3 way stop (which is notorious for people going through the intersection with out stopping). I was turning left and during that time there were no stopped cars. I was hit on my drivers side by a woman going straight. My car ended up being totaled and due to that I haven't been able to go to work and I had to drop out of school. No witnesses were written in the police report and I was unaware that anyone saw the accident until my insurance company informed me of a witness that came forward. I believe that it is a false witness.

It sounds to me that the other driver might have run the stop sign, as you already were in the intersection. You might want to have an attorney evaluate the case, especially since you lost time from school and work, and have been injured. Your own insurance policy might have some medical payment provisions that are "no fault," that might cover some of your medical expenses, at least.
You may have a civil case and you should definitely review this with an attorney. What does this new witness say happeend?
