Legal Question in Civil Litigation in California

chargeback threw paypal

10/06 we had a camera sell on ebay, 3 wks later the guy changed his mind, filed to get his money back threw paypal, it wasnt looking to go his way, so he went to his credit card co. got his money back mid november, but refuses to send back the camera 6 months later we have nothing and paypal wont do anything even though they are the ones who released the funds back to his creditcard co. now they say they cant do anything. shouldnt he have sent the camera back first? they froze our account too, so its not like he wouldnt have gotten his money. we cant take him to sm. claims because we are in Ca. and he is in Mass. he has been unreasonable threw this whole thing and paypal is no help either. we feel its there obligation to get the money or the camera back, beings that the money transfer was threw them. they did give us half the money it sold for because of the situation, but that just makes it seem to me that they knew they were wrong and made a mistake. shouldnt they be held accountable? thank you

Re: chargeback threw paypal

It would apper from your post that Paypal acts as an escrow agent. I would sue paypal. You need to find out their identity, (i.e. corporation, subsidiary, etc.) and where they are located.

If they are in California, I would sue here.

Very truly yours,
