checks as contracts

we have a small claims case against an unlicensed auto repair garage. We paid them by check. Is there some kind of contract implied in that? We went out 5000 back because they did a crummy job.

The contract is that they provided service and you paid them for it. The service they provided should have been reasonably done. If you file a small claims case, you should bring with you as a witness someone from another repair shop who could testify as an expert about the crummy job they did and how much it cost you to do the proper repairs.
