Legal Question in Civil Litigation in California
civil rights violation
I suffered assault, battery, false arrest, false imprisonment at the hands of 2 policemen, over my objection. One officer even placed his hand on his gun when I said no to their request to search myself and belongings. The officers gave me no reason at the time even for the request. The first officer, said I could leave, after I asked to see a search warrant, upon leaving the second officer, placed his hand on his gun, demanded submission, and both officers forced a search. This was done in front of me family and friends.(I was on foot) Can I sue and win?

Re: civil rights violation
There are several variables that would affect
whether you would be successful in winning a case
against the police department for assault. One of
which would be whether they had probable cause for
the detainment, according to the law. Another would
be whether or not you were actually physically hurt. You
might still have a case even if you were not physically
hurt. In order to give you a better estimate of
what kind of case you would have I would need to
talk to you. My office is located in San Luis Obispo,
but I practice law throughout the state of California.
I am currently suing the City of Paso Robles for an
extremely similar incident which occurred in Paso Robles
and involved my client and two police officers.
Please email me with your phone number or call me
direct at 805-546-9909 so we can discuss your potential
case. There are several deadlines that need to be
met when pursuing a claim against a government agency
so you need to contact me or someone immediately in
order to pursue a claim.
Talk to you soon.
