Legal Question in Civil Litigation in California
Considering Civil Suit, needing advice.
Thank you for reading my situation.
I sold my time and a service via an auction to a man in Texas in May of 2001. He paid me $500 via PayPal with a credit card that he then reported as stolen. The charge was charged back to me. I wrote him and he responded with several emails stating that he was ''working on getting this situation sorted out''. Five months later, he now claims that he no longer wants to pay me. He claims that the sale of the game account was not allowed by the on-line game company through which I provided the service. The on-line game service does state that you should not ''sell'' accounts of its game, however, I did not sell anything within the game. What I sold was my time and effort to put the account in a certain state, which I very clearly stated in the auction. The purchaser is trying to avoid paying me money that was promised.
What do you think about this situation? Do I have a strong case? Does the game companies policies even matter? The more information the better.
And, if I file a claim against this person, does he have to come to California? Me to Texas? Something else?

sounds like a good case. try filing in CA and see what happens.
