Legal Question in Civil Litigation in California
Civil Trial ''Brief''
Greetings. I have a civil jury trial coming up 10/31/05. It
concerns a credit card billing dispute. I must submit a trial brief by 10/24/05. I have no idea what a trial brief should contain. Can someone provide an outline of what the brief contains?
Thank you!

Re: Civil Trial ''Brief''
A trial brief must contain all of the following and "resemble" the format of other items that have been filed inthe case.
Ruled and numbered paper;
A Caption [Smith v. Jones]
Heading: Brief Description of Case {in 2 para describe what the law suit is about, then set forth the parties and their positions
Heading: Your [Plaintiff or defendant] Position
here you tell ina few para why you should prevail, ex, disparagement of credit, failure to conform to Fair Credit Reporting Act, etc.
Heading: Memorandum of Law
Here you set out the applicable case or codified law that is in your favor.
Heading: Conclusion
Here you state "Based upon the foregoing memorandum, [you are entitled to] the relief sought.
end with Respectfully Submitted,
