Legal Question in Civil Litigation in California

How do I collect on a judgement in California?

I need to know how to collect on a judgement awarded me against a former employer, by a California Superior Court. The deffendant has moved to another state, and is well suited to pay the judgement. He has stocks, various land holdings, a business, etc. but it seems to be well protected. Is there anything you can do to help?

Thanks,

Your judgment is enforceable in every state. You should hire

an attorney (debt collection practice) in the state(s) where the

assets are located. Your judgment can be filed in any state, and a

local judgment issued which (with proper procedure) the local sheriff

or other law enforcement agencies will enforce.

Re: How do I collect?

It depends on the state which the person has fled to. You need to hire an attorney

to "go after" the individual. Methods of collection are many. They include;

wage garnishment, debtor examinations, bank account seizures. While these tend to be successful,

they can also be very expensive. How much is the judgement for?

I have done many collections, please feel free to contact me to discuss further.

Re: How do I collect on a judgement in California?

Your judgement is good in any state however in order

for that state to recognize the judgement an Abstract

of Judgment needs to be filed befor the new county

will file any wage garnishment or any other liens.

This paperwork is somewhat complex in that there

is so much of it. An experienced collections attorney

would be the best bet. Additionally, you will be

required to pay a filing fee to the county where

the judgment debtor now resides when the abstract of

Judgment is filed. More information is needed to

determine if the judgment is worth collecting in

another state. I have access to a nationwide database

which contains personal records of almost everyone in

the United States. If you have the Judgment debtors

social security number I would be able to determine

what if any assets he has and then place liens on those

assets. I would be happy to offer you a free consultation

over the phone so that we could discuss your options

and various methods of collecting your judgment. I can

be reached at (805) 546-9918 or you can email me

with your phone number and I would be happy to contact

you at your convenience. I look forward to hearing

from you.
