Legal Question in Civil Litigation in California

Collecting damages in Small Claims Court

Can the plaintiff sue the defendent for lost wages in Small Claims court (in CA)? I was under the impression that they could only sue for court costs but cannot verify this.

Re: Collecting damages in Small Claims Court

The plaintiff cannot recover for wages lost on the day he has to appear in court, but he may be able to recover for lost wages which are a direct result of the defendant's conduct. Thus, if a defendant injures a plaintiff, who then has to spend a week recovering at home, the plaintiff can seek to recover the wages lost during that time. He cannot, however, seek another day's wages for the day he spends in court.
