Legal Question in Civil Litigation in California

Collections, Medical bills

I received a notice from the hospital collection agency with a notice to pay balance within 7 days. This is 15 months after the service and the first billing I have received. It seems a little late to be sending me a bill at this time. Is ther a time frame that I should have been billed in.

Sugery was on 09/24/96. Hospital did not bill the insurance co. until 01/05/98. My notice was received on 01/26/98. All other billings, such as lab, Dr., xrays were received and paid in a timley matter.

Medical Billing Problem

Your answer depends on the type of insurance you have and the paperwork that you signedwhen you were admitted. My suggestion is to write a letter to the Hospital and advise themthat you had insurance and that you will forward the bills to yourinsurance company, however, they should not be billing you. Most contracts withmedical insurance companies state that the medical provider SHOULDNOT bill the patient directly.

Try that and see if it works. If it does not you may haveto hire an attorney to help you.
