Legal Question in Civil Litigation in California

Comforter damage

I have received an e-mail claiming I damaged her comforter and wants to be reimbursed and wants a letter of admission of guilt or we are headed for court. I can't do this since I know nothing about it. I'm transferring to WA. in ONE week. Is this simple e-mail "Demand Letter" good enough to bring me to court or does she have to hand deliver it? I don't know how to defend myself. I just know I didn't do anything to her quilt. Help!!!!!!

Re: Comforter damage

To bring you to court you must be personally served with official court papers. Ignore the email.

Re: Comforter damage

This lady obviously has no idea what she is talking

about. If she decides to actually file a lawsuit

against you, you will be personally served by someone

other than her. If she serves you that you don't need

to do anything because this is illegal and therefor

you were not served. Additionally, if you do move out

of state she can serve you by certified mail. In that

case you do need to answer and appear at court. However,

this does not seem likely. If she threatens you again,

threaten her and say that if she files a lawsuit you will

file a counter suit for malicious institution of civil

proceedings.
