Legal Question in Civil Litigation in California
Continue a Jury Trial Court Dat?
Hello.
I would like to ask the judge to continue the current May 2009 jury trial court date to a later date? How do I go about doing that? It is a civil lawsuit - breach of contract.
Thank you

You might ask the other side to sign a stipulation you prepare for that purpose. You would have to put a good reason for the continuance in the stipulation, then file a motion that attaches the stipulation.
Or, if the other side is unwilling, you can file a noticed motion with declarations explaining your good reason and that opposing counsel won't stipulate to your request. Either way, it will cost you a filing fee for the motion.

I would ask opposing counsel to agree to change the trial date. File an agreed stipulation to change the trial date if opposing counsel agrees.
