Legal Question in Civil Litigation in California
I had a continuing writ of garnishment issued from the state of Florida against me for 25% of my disposalable income for a garnishment that stopped in 2002 and there has been no communication from this company in 9 years so I assumed the debt was paid in full. I can not afford this as it will cost the loss of my home and transportation. Can they do this if I am a resident of california without ?
obtaining a Sister State judgement
1 Answer from Attorneys
They can if your employer is subject to Florida jurisdiction. They only have to get a sister state judgment to use California resources for enforcement. If the employer does business in Florida as well as California, or for any other reason is subject to Florida jurisdiction, it is subject to Florida authorities and must comply with the Florida writ no matter where you go.
