Legal Question in Civil Litigation in California

Court Judgement - Bank Account

A credit card company received a judgement to go after my mothers bank account for a debt I owed, her name was on the account but never used the account. She receives SSI and a suvivor benefit pension from the Navy. As of now the bank has frozen her account, and she has no money what so ever to live on. I have asked the company several times to just garnish my wages, and they refuse. Can they go after her government pensions?

Re: Court Judgement - Bank Account

They can if your mother was also a defendant in the lawsuit and if the judgment names both of you. This is probably what happened, especially if she co-signed the loan agreement.

If your mother has nothing to do with the debt, it's possible that the credit card company persuaded the court that the account is really yours and not hers, or that you both use it. Your mother can challenge this finding, and should consult with a lawyer about how to proceed.
