Legal Question in Civil Litigation in California
custom car problem
My son had bags (hydraulics) installed on his car -- $3,000+ in August '00. The car has gone back to the shop more than 7 times. The spindles broke on the front-right side twice, both times while driving. The car has gone back for numerous reasons, and is still in the shop. Since August he has not driven the car, in total, more than 1 month. This last time, two weeks ago, the spindle broke again - the car had to go back in. Now the owner says the warranty has expired, and he wants me to sign a contract stating any additional problems will need to be resolved by me; he would take care of the problem at a $300/hour labor rate. He will not give me the car unless I sign.
I understand, under normal circumstances, the warranty would have passed but the car has never been fixed, and I dont think I should bare the burden of their faulty craftsmanship. I had faxed these folks after the first time that I wanted the car put back to the way it was - they tried to fix it. When the spindle broke the second time I again asked the same request. Again, they have tried to fix it. I have copies of the faxes sent and all of the receipts.
What can I do?

Re: custom car problem
dont sign ANY contract. ask for police help to get the car back. if they wont help you will need to sue him for the car.
