Legal Question in Civil Litigation in California
my daughter loaned her bicycle to her roommate to use for one day. the bike was stolen that night because the girl did not put the u lock back on the frame as it was when she unlocked it to borrow it. the roommate does not feel responsible. legally does she have to replace the bike with a comparable bike?

Why does she not feel responsible? Havilng borrowed the bike she was under a duty to use reasonaable care to prevent damage or loss to it. Not putting on the lock was negligent, so she owes your daughter the fair market value of the bike; she can not be requried to purchase a new bike, just pay the value of the old one.
