Legal Question in Civil Litigation in California
defamation of character through e-mail
I have a sister that has written e-mail to me in a derogatory way, talked to neighbors where I used to live in CA trashing me, writing a letter to my daughter and trashing me. We also have found out quite recently that she has been accessing my mother's e-mail. Somehow she got my mother's password and has been reading her e-mail for at least the last 2 years. Then just the other night my mother called and my sister had e-mailed a ''forwarded'' e-mail to another sister by cutting and pasting my e-mail address on top and then putting my name on the bottom. I never sent that e-mail. Is there some sort of action I can take against my sister to make her stop all this and if so what are the charges? Thank you

Short of filing a lawsuit against your sister, I would notify her ISP and tell them that she's violating its rules and regulations, and let them sort it out. Maybe they'll pull the plug on her.
Re: defamation of character through e-mail
You need to contact a lawyer where your sister is located. On top of possible civil actions, your sister may have violated state and federal statutes concerning the interception of other person's email.
Re: defamation of character through e-mail
You could contact the FBI and also the District Attorney in the district where the email was intercepted. Because it seems to be a family squabble, I have my doubts about whether they will want to get involved and take the matter to the grand jury. If so, and if that is your objective, you may be able to get your sister convicted and imprisoned.
