Legal Question in Civil Litigation in California
definiing my claim
My complaint went to EEOC Administrative Judge... Do I have to clearly define my claims and effects and post history of retribution for protected activity? Since the original complaints were filed I had new developments 6 months after original filing... Moreover, there was a breach of contract and violation of Equal Pay Act, could that be a separate claim in Superior court or EEOC will still consider it?

Re: definiing my claim
"My complaint went..." "Since the original complaints were filed..." This passive-voice language dodges the question of who filed these complaints. Surely you didn't file them yourself, and surely this isn't the first time you've sought assistance from a lawyer?? Unfortunately I suspect this is the case. If your attorney had filed the EEOC/DFEH complaints, you'd be in Superior Court by now, and maybe your case would have settled by now.

Discuss with the attorney who drafted the complaint. He or she would be in the best position to respond to your inqury.
