Legal Question in Civil Litigation in California
Dismissing a lawsuit
I am a plaintiff in pro per. I had filed a lawsuit against three defendants in the superior court. One of the defendants has reached a settlement with me. However, the other two defendants do not want to settle.
I like to dismiss my lawsuit against the agreeing defendant and continue with the remaining two defendants. Are there any prescribed forms to do so?
Thank you for yourt advice.

Re: Dismissing a lawsuit
You might wish to bring a motion for determination of good faith settlement, so that the other defendants can't later -- at trial -- point to the settling defendant's chair (figuratively) and say, it was he/she who was solely responsible.
If you don't do that, you could file a request for dismissal. You can find the form on the Judicial Council's web site.
