Legal Question in Civil Litigation in California

Employee Property Damage

While at work, my husbands truck was damaged by a large unsecured container w/ approx 25 unsecured fire extiguishers inside that blew over because it was windy. Employer refuses to pay the $1500 it took to fix the vehicle because he wasn't in a ''designated'' parking space. He was never told not to park in that area, just the opposite.New container is now securely bolted to concrete and fire Ext. are securely wrapped inside it.We have pic of everthing and a winess re/ the parking situation. We have liability Ins. only. Do we have a small claims case?

Re: Employee Property Damage

Yes. If your husband was told (by someone with authority) that he could park where he did and if the employer's negligence led to the accident, then he should prevail in a small claims action.
