Engagment ring - What is the rule in CA?

I live in California. I proposed to my girlfriend ablout 2 months ago. However, I would like to call it off and get my ring back. Am I legally entitled to get my ring back if I want? what should I do legally to get it back if she is not willing?

I believe it depends on your "understanding." There may have been none, as you intended to get married and probably didn't make a contingency plan re: getting the ring back. Fundamentally, if it's a gift, I would argue you have no right to get it back. If she helped pay for it in any way, she's entitled to part of it. A practical word of advice, law aside: be classy and let the girl have the ring. Doubly advisable if you're the one who is breaking things off. If she insists on giving it back to you, that's one thing (and she just might, making your problem easy to fix). Alternatively, find some middle ground on the issue and get it resolved without going to court. I'm not sure you want to be known as the guy who bought a ring and sued to get it back after you broke off the engagement.
