evicting section 8 (hud) tenants

My tenants are section 8 recipients and I would like to evict them so that my family members can reside in the unit. Also, the tenants are consistently late on rent, have an unauthorized person living in the unit, are noisy, and we believe they have conducted illegal activity in the home; what is the legal way to evict them?

I would contact the local agency that is in charge of section 8 housing. I am not sure if there are special criteria that needs to be followed to evict section 8 recipients. However, it would seem that just because our tax dollars pay their rent shouldn't mean they are exempted from being evicted. But what is logical isn't always legal. Start with the section 8 housing authority or whatever agency oversees section 8 housing. Tell them the problems you have had with the tennants and that you would like to reclaim your property. Hopefully the standard thirty day eviction notice will be sufficient. Good luck. Don't do anything until you have something in writing from the agency in charge outlining your responsibilities when evicting the tennants.
