Legal Question in Civil Litigation in California

If someone I know is falsely accused and convicted because they signed a waiver/agreement to settle out f court instead of court, can I sue the accusser for the allegations, especially since there was no cross examination?

No. With rare exceptions in business and insurance transactions, you can't ever sue for something that didn't happen to you.
