Feduciary duty and small claims court

My sister called and asked me to invest in a joint stock investment, I made the check payable to her. She claims she gave the money to someone else to invest but she never got any documentation and now claims the stock is no good. I amm going to sue her in small claims court but from what I understand I have to go to court where she lives in No. Calif and I live in So. Calif, We entered the agreement over the phone but I sent the check to No. Calif. Do I have to go up there to go to court? Also if she did give the money to someone else but did not get documentation do you think I have a case?

it sounds like a very good case but you probably will have to go up there. You might also report the incident to the SEC and see if they can do anything for you.
