Legal Question in Civil Litigation in California

How to file an answer to a summons

I was served with a summons on a Petition to Vacate Arbitration Award. I won this award through arbitration, now the company doesn't want to pay me. I have to answer this summons and would like to know the format in which this has to be answered, i.e., can I just type up my response to the allegations on a regular paper, put numbers down the side, or is there a form that has to be used. This was filed in the Superior Court of the State of California, County of Orange, Central Judicial District. Then, I presume I have to take it to the court to be filed, and pay a healthy fee. Is this correct? Thank you.

Re: How to file an answer to a summons

Unfortunately, the LawGuru webmasters just posted your message today -- they had a serious backlog of messages dating back to the summer, which had not been reviewed due to the time and effort they put into a software upgrade (while also running their own law firm).

The result, in your case, is that your message took more than two months to reach an attorney. While I do not know exactly when you were served, I believe your deadline to respond has already come and gone. Hopefully, you have responded by now, either on your own or with the help of an attorney. If not, you should consult an attorney immediately.

Without more specifics, there isn't much more that I can tell you. Feel free to call me (310-575-3540) if you wish to discuss this matter further.

Yes, you can put it on plain paper but it must be in the proper form. the filing fee will be just under $200.
