How do I file a complaint in the court against storage?

I had a verbal agreement with the owner of the storage, to work 2days a week,in exchange for the housing.The housing was on the storage lot.I moved in and started to work on 9/01/03.The owner also gave me free storage to keep my

belongings, that I had. On 9/17/04 I received a 30 day notice to vacate the premise.I should have received a 60 day notice,after the new law went into effect.They let me go, to hire one of their family member.When I moved out I

told them I would come back and get my things out of the

storage within 30 days.When I came back,all my things were

thrown out,without notifying me of their intent. My question is,since it was verbal agreement, ''How many years

is verbal agreement valid? Is it 2 or 3 years? How do I go

about filing a complaint,in the court for damages? Can you

attach a sample complaint to the e-mail,so I can file it

myself.I also need a sample of the answer to a complaint.

Please let me know if I still have time to file a complaint

or is the statute of limitation passed? All my things were

thrown out in 11/03. Do I still have hope to recover my damages? If you can't send me sample,please tell me where

I can look up the case on the storage.What citation.Thank

you for your help.

Yeah, you might still be within the CA statute of limitations, and if your damages are less than $5000 you can sue in small claims court (go to the courthouse law library or public library and ask for the Nolo Press book on Small Claims Court, or ask the small claims advisor at the courthouse). The judge is going to want to know why you didn't get anything in writing and why you waited so long to sue. Hope you kept sales receipts or photos to prove the value of your property.
