Only if you are a district attorney or a city attorney.
What Mr. Roach means is that only district attorneys can file criminal actions. As a former Deputy City Attorney for the City and County of San Francisco, I can also tell you he is wrong about city attorneys filing criminal proceedings. The power to do that is vested in the district attorneys of the state and the state Attorney General. City attorneys and county counsel are civil law attorneys, not criminal. Returning to your question, however, you are completely free to report a crime to the police or district attorney after you have filed a civil case even if it pertains to the same matter. It's up to them if they file criminal charges.
