What is a Statement of Location which is needed when filing an Unlawful Detainer?

I am an attorney in Southern California. I assume that you are filing in Los Angeles County since they are the only Southern California County that uses the form entitled Statement of Location. However, other counties use forms of differing names for the same purpose. In San Bernardino and Kern Counties, for example, essentially the same form s called a Certificate of Assignment.

The statement of location is required in all new civil filings, not just unlawful detainers. The purpose of the Statement of Location is to provide sufficient information to the court to allow the court to ensure that you are filing in the correct branch court.

The need for the form arose to prevent plaintiff's from filing lawsuits in branches more favorable to a given situation. For example, some one might try to file in the nearest court rather than the correct court at 4:30 in the afternoon to preserve a statute of limitations expiring on that day because they could not get to the correct court in time. Another one is that there is one branch court in L.A. County that is known for juries very favorable to personal injury plaintiffs, so much so that plaintiff's attorneys refer to that branch as "The Bank." That is the only purpose for the form. It is a form you have to get from the court that says you are filing in the correct court because the house is in the court's general area. i.e. you cannot file an action in Chino Court if the residence is in Victorville.--WARNING--if you are trying to do this on your own, you could very easily get burned--it only costs about $300 to use an attorney (not including process server fees and filing fees.)
