Legal Question in Civil Litigation in California

Best Friend backs into my truck and won't take responsibity

One of my best friend was parked in my drive way with her suburban. She left and backed into my truck that was parked accross the street. It was the same color of her paint and black bumper mark. I called her and asked if she would bring her suburban over to match the paint, black bumper mark and to measure to prove that it was her that did it. She told me that she will not bring her suburban over and that she would not talk to me about it. I no for sure that it was her that did it. Do I have a case in small claim court without a eyewittness??? I feel that I have a strong case

You need more. drive to her house with a camera and examine the truck for missing paint and get a photo of it.

Submit a claim to your insurance company. After they pay the claim, they can decide if they want to get the money from her. If you were uninsured,find out if she has insurance and contact her insurance company because they will pay you faster than she will.
