Legal Question in Civil Litigation in California

Gifting

A close friend wanted me to buy a motrcycle so I could ride with him. I said I could not afford it.I had one that I liked, but it was too much for me money wise. A couple of weeks later,he called the dealer, and asked if that bike was still there. He then told me,that we were going to pick up the bike. He said it was for me,and don't worry about paying,he would buy it.We arrived at the dealer and told him to put the bike in his name, because he bought it cash ( check). He said no, this is your bike, it was for me.I said that I was very grayteful and I would pay him back someday, He said don't worry about it, get me back when you can. We had an arguement a week later, and he asked me to move out of his house. I did,and he said he needs me to to sign over the title of the bike,or pay him in full. I have full title and registration in my name only. I suggested a payment plan which was fair . The bike is in his garage and he has a lock on it,he has since said pay in full,or sign it over,or he is ready to sue me and has an attoney. Do I have a claim to this bike ?

Re: Gifting

You may have a claim to the motorcycle as a gift from your friend. However, it maybe costily, in both money and emotions, fight for the motorcycle. You may wish to try to work out a compromise with him.
