do I have to give a deposition

my wife is being sued over a cat bite. The lawyers for the plantiff are asking me for a depostion. Do I have to give one?

Depends. If the suit is a limited jurisdiction case they are entitled to only one deposition and they would prefer your wife's over yours. If it is unlimited jurisdiction [look at the top of the pleadings to see which it is] they can send you notice of your deposition and then you have to file a motion to prevent the deposition, but on the face of it you should have some information as to the general behavior of the cat so a deposition would be reasonable. If you wife has insurance coverage [homeowners insurance will often cover such cases], ask he attorney what he/she is willing to do. If you are asked questions of a confidential nature at the deposition you may be able to use the husband-wife protection against having to testify. Why not try to find out the reason for their wanting to take your deposition and making you can convince them you know nothing.
