Legal Question in Civil Litigation in California

Harassing calls from another state

My relative, who lives in California, is involved in a lawsuit with someone in that state. I live in Georgia and a person related to the person he is suing is calling me from Calif. and leaving harassing and threatening messages on my machine. He has called 3 times and he tells me to convince him to stop the suit or they will counter sue. He continually makes mention of drug abuse and pornography on my father's part (which has nothing to do with the case at hand). What can I do to stop/report these calls properly. We have recorded/logged all of them.

Re: Harassing calls from another state

You can seek a restraining order against him if you want. The order can probably be obtained either in California or in Georgia, but a California order will be easier to enforce.

Be careful about the recordings, though. You can use messages left on your answering machine in court if you want to (since he knew he was being recorded when he spoke), but surreptitious recordings of telephone conversations are inadmissible and making such tapes is a crime. Unless the other man knew he was being recorded, you should not plan to use the tapes.

Please feel free to contact me if you want to pursue a restraining order here in California.

I would start with a complaint to the phone company and the cops in CA
