Legal Question in Civil Litigation in California

Harassment by fired contractor

We are have a home built. The contractor was not finishing the work, the work that was done had a lot of problems and he was alway demanding more money for work not performed yet. We had enough and on 11/13/00 we put a stop payment on a check he had for future work and fired him. Since that day he has gone over and harassed our friends and anyone that tries to work on the home. He has people so scared that one friend will not even talk to us because he fears for his life. The contractor also broke into the home on 12/6/00 and called the police saying that our friend who was correcting some bad construction work done by this guy, had vandilized the house. He has told us over the phone that he is not going to leave us alone and has showed up at our bank with some written letter he wrote and tried to put a hold on our bank account.

I also just found out he has done jail time for threating his own sisters life. HELP...What kind of legal action can we take to ensure our safty and get the contractor from hell out of our lives. We have contacted the police but so far they have only increased the patrol of the house. We really are in fear for our lives. I don't feel that we are over reacting. We do not owe him any money.

Re: Harassment by fired contractor

You can file for a restraining order. What this means is that if he comes within say 500 feet of you or your residence you can call the police and have him arrested. A restraining order has to be filed in Superior Court so it will cost you about $200, depending on which county you live in. The clerks office should be able to give you all of the forms needed. They are pretty simple so you should be able to complete and file them out yourself. You will have to go to court and show the Judge why you are requesting a restraining order. A copy of the police reports you have filed as well as testimony from yourself and the other people he has threatened should be enough to get the order. If you have any other questions please feel free to email me directly at [email protected].

Good luck.
