Legal Question in Civil Litigation in California

Hotel Stay

The front desk rep at a hotel made a key for a man who said he was staying with me. The man entered my room as I was getting out the shower. I yelled for him to get out, pushed him out the door, and he opened my door again, told him I would call the police and he left. The front desk denied making a key, after the manager researched , he found that a key was made.....can I sue?

Yes. I'm not sure how much a case like this would be worth, but based upon what you have written I'd say the law is solidly on your side.

Re: Hotel Stay

Mr. Hoffman is correct that with those facts you have an excellent case. The hotel was clearly negligent. The value ofthe case depends upon whether you are a man or woman, your emotional reaction to the entrance, whether you went for treatment because of the incident, how good of a witness you are, whether the man who tried to enter appeared to be untrustworthy, etc.

You could interview [during the free initial session] several attorneys to see what they think the range of values might be. If you want more than a few hundred dollars or a discount at future stays at other branches of that hotel, then you probably will need an attorney to represent you. You can contact the hotel to see what they are willing to offer; they probably will ask why you did not lock the door from the inside so no one could enter [failure to do so is not necessarily negligence on your part].
