Legal Question in Civil Litigation in California
Hi, My husband and I sold a street bike to a friend back in December 2008. The agreement was that they would take over payments and have their own loan by the end of the six months from date of sale. Six months passed and they were unable to get their own loan, so they asked for a four month extension which would put us at October 2009. Well that passed as well and they have not gotten their own loan. We are now in April 2010 which means they have had the bike one year and four months. I don't know what to do at this point and all he keeps saying is he will have a loan soon. They are late on payments and not to mention they move all the time so I'm not positive where they even live now. What should we do? Will we be able to get our money if we go to court? Thank you so much any advice would be great!

Request that they return the bike. If they refuse, then you can take them to court for the remainder of the purchase price.
