Legal Question in Civil Litigation in California
I was an independent Contractor with FARMERS Insurance Group for 3 and half years (Captive Insurance Agent), about a year ago I resigned and took the value of my book of business.
After half year, I became a producer for another Farmers Insurance Agent. However, two days ago the Agent got e-mail from the District Office Manager regarding that I was being his Agency producer would resulting his contract with FARMERS may be terminated because I am being his Agency producer and saying that the reason I got terminated by FARMERS was because I was cashing the customers checking into my own bank account.
But my contract with FARMERS Insurance Group WAS NOT terminated. It was I resigned.
Because I was resigned with FARMERS and my former District Office Manger should have no right to disclosure or writing or saying the wrong statement about me was terminated by FARMERS. And pointed out that I was doing such wrongful things.
My question is can I sue the District Office Manager for Defamation of my reputation?
My case points:
1. I was not terminated; I resigned and took the value of my book of business.
2. My former District Officer Manger bad mouth me.
3. He put threats or pressure on another Agent, which is my Boss against me, caused me losing my current job and resulting of no income losing my house.
4. I could have no job for a long time in the insurance industry because hes spreading out the statements about my contract was terminated by FARMERS which is not true.
My question is: Can I sue the District Office Manager for Defamation of my reputation? or Can I just sue him for caused my difficult time?

The situation you describe, if proveable, would be a one of the very rare cases in which a defamation claim would be worth pursuing. You mention that you have lost your house, however, which suggests this happened a while ago. If so, you may have statute of limitations problems. You should contact an attorney immediately.
