Interrogatories
I have a case pending in Federal Court. I have received a set of interrogatories from the defendants. They (Defendants) are referencing Code of Civil Procedures, and I was instructed to go by the Federal Rules of Civil Procedures and the local court rules. Who is correct?

As long as the case in being tried in Federal Court, the Federal Rules of Civil Procedure govern in procedural matters, such as how much time you have to answer the interrogatories and the format of your answers. However, just because the interrogatories may erroneously refer to the California Code of Civil Procedure doesn't mean you don't have to answer them. Also, I don't think the procedures for asking and asnwering interrogatories are all that different between the two sets of rules.
