Legal Question in Civil Litigation in California

Interrogatories/Stipulated Agreement

I have a stipulated agreement with opposing councel that said I would sell my mobilehome & give him the money, whatever money that was not paid (from the $ I owe) would be made in monthly payments. I sold my MH & send him $50 payemnts on the 1st of every month. Yet he has served me with Interrogatories. Can he do that if I am making my payments per our written, signed Stipulated Agreement????

He probably wants to confirm that you're paying as much as you can and haven't lied about any numbers. I don't know about CA discovery law, but our CA attorney can advise you if you wish.

Re: Interrogatories/Stipulated Agreement

No one can answer that without seeing what the stipulations were. You may have only agreed to a payment plan and not to a halt in the litigation. If you want, you can fax me or e-mail your number the stipulations at and I will look through them and respond without charge. Also, how much did you give him from the sale of the mobilehome, are you willing to have the litigation be put on hold until the debt is paid off which would probably require you to agree to a judgment being entered against you and might effect your credit rating if it is filed by the other side.
