Legal Question in Civil Litigation in California
If a judge dismiss my case or the opposing team dismiss my case. Can I still sue to get my filing fee back. At that time can I hire a lawyer to do such claim for me. If not. what forms do i have to fill out to request for my cost of the trial. I believe this case will dismiss because I'm not the owner of the car but when they were suing me they thought i was the owner of the car. Thank you.

If you successfully defend against a lawsuit, you are entitled to your costs from the other side. That generally does not include attorneys fees, but does include filing fees, motion fees, etc. Once you are the prevailing party, you file a form that can be found on the Judicial Council website courtinfo.ca.gov asking for an award of costs.
