Judgement Collection
My vehicle was hit by a 14 year old kid driving his parent's vehicle. His parents did not pay for the damages done by their son, so I had to sue them. I currently have a small claims judgement that was awarded to me by the court. The judgement is against the minor and his father and has not been paid yet. I have requested an Examination of Assets on his father, but this person is very evasive and has not been served. Can I request an Examination of Assets on the minor's mother? I ask because I only sued the boy and his father.

First amend your judgment to include the wife--the debt is community property debt!
Then after you amend the judgment, record the judgment and then bring in the wife. If you record the judgment (abstract of judgment) it is a general lien on all property of the debtor.
