Legal Question in Civil Litigation in California

A neighbor pulled into my driveway one day to ask me a question. He left his car door open while he spoke to me.

The following morning he walked down to my house (about 1 block away), and asked if my cat was missing last night. I replied that I did not believe so. He continued claiming that he unknowingly locked the a cat in his car overnight (that looked exactly like mine) and it urinated on his carpet. He believes that the cat climbed into his car when he entered my driveway and left the door open.

I have since recieved a bill for $500.00 for new carpets.

Your analysis of the situation would be helpful.

You are not responsible for this, he is. He is the one who was negligent in letting the cat going to his car. Also, it does not even sound like he is very sure it was your cat. Tell him you want a DNA test done.

If you have a home owner's policy notify you agent of the claim. Then if he sues you can turn the claim over to your home owner's insurance.
