Legal Question in Civil Litigation in California

My lawyer demanded, insurance adjuster denied liability do i go further

I was in an accident.

I was going straight in the far right lane

a lady in the opposing left pocket turned

infront of me i still had the right of way

the light was still green as i approached the intersetion i warned her with a horn that i was continuing through the intersection. but she disregarded my warning and turned it was too late

i slammed my brakes but it was too late

my lawyer demanded money, the adjuster denied all liability, even though their client is at fault

now i dont know if i should continue this "soft

tissue case" or not, is it worth the time and money

p.s. i have an arbitrary agreement w/ my lawyer

do i pay doctor fees if i lose, quite the case

what about small claims

I would definately pursue this case further. Even though your injuries are "soft tissue", in most cases these types of injuries take longer to heal than if you had broken your leg. You will most likely suffer from pain for some time which may cause you to lose time from work and your quality of life. Just because the insurance company won't pay, which is what they are supposed to do, doesn't mean that you aren't entitled to reimbursement. Only you can decide if it is worth it, I dont know how bad the injury was or how long it took to recover. Yes, you would still have to pay the doctor. Small claims court is an excellent option for smaller cases but keep in mind the limit there is $5,000
