I have a legal dilema, and dont know what to do. I just found out that one of my family members has been claiming my daughter as their dependant for health insurance and income tax purposes, for the last 4yrs. This has been done without my knowledge. I need to know how I can protect myself legally, as this family member told me that if they were found out,, that they would say that this was done with my knowledge and permission. I have not contacted the IRS, or this family members health insuranc company yet, as I wanted to know where I stand before I turn them in. Ed gave you some good advice that I think you should follow but i would also recommend that you cc the IRS on the letter.

You should immediately make a record by sending your relative a letter stating that you just found out (include a specific date if possible, and you might want to explain how you got the information) about this arrangement and that you have never authorized them to claim your daughter as a dependent. State that the relative has threatened to implicate you if caught and that you will testify truthfully against them if the need arises. Send the letter via certified mail, with a return receipt requested. Keep the receipt and a copy of your letter in a safe place.
Your relative has evidently been committing tax fraud as well as other offenses. These are serious crimes and will likely result in investigations and, perhaps, prosecution if he is discovered. Investigators will probably not be fooled by his claims, but if you remain silent after learning of his actions, you may make his story easier to believe.
