legal vs moral

can fraud still exist if the oral contract offer was invalid due to its consideration. does legality superceed over the sure morality of the subject matter in a case?

There needs to be consideration to form a contract, oral or otherwise. It can seem uneven on the outside, but any consideration at all is adaquate to make a deal. The law is going to supercede any moral considerations: that is, for instance, saying that "it's the right thing to do things way x, but under the law you can do them way y and still be okay." Perhaps you're thinking of a situation where another party should do what's right, but they are not obligated by the law. Whatever you do, next time, get it in writing. If it comes to being disputed later, then it is much easier to prove there was/is a contract.
