Legal Question in Civil Litigation in California
Legality of Contract
I have a judgement against a international company for $30,000 based on a employment suit. I was presented a check and when I went to cash it it was negotiated on a closed account. The company will not reissue the check unless I sign a new legal agreement admitting that I never cashed the check and the company acted in accordance with the agreement. They will not reissue the check unless I sign the agreement. Is this even legal to ask me to sign an agreement that the company knows is based on false information? Isn't an ethical violation for the lawyer?

If you already have a judgment, then no further agreements are needed. It is against the law to write bad checks. By writing a bad check then they did not act according to the judgment, and it may be advisable to demand a cashiers check. Did you have a lawyer to obtain your judgment? Contact me directly.
