Legal Question in Civil Litigation in California

Leins and collection agencies

My son was in a car accident 5 years ago. He was sued by the insurance company for driving on suspended license and damages. He called the collection agency up to make arragements/payments. He explained that he just got a job and that he would like to make arragements. They told him he had to come up with $1500.00 by end of week or they were going to get his license (which he now has with insurance) taken away. He explained that his new job entails him to drive and they told him ''to bad'' if you don't have the money we are going to take your license. Can they do that? If he loses his license then he loses his job. He then can not pay them. are they using scare tactics on him?

Your son may have a claim against the collection agency under the FDCA. We would need to review all letters, judgment, and correspondence. Please call us if you need further assistance.

Sounds like a scare tactic. Collection agencies are notorious for making debtors fear jail, loss of license, etc., to secure overnight payment.
