Legal Question in Civil Litigation in California

Liability for encroachment of tree roots.

What is the liability of a property owner when tree roots from his property encroach onto a neighbors property? Also, do you have the right to trim branches from a neighbors tree that overhang onto your property?

Thank You

Re: Liability for encroachment of tree roots.

The owner of the tree is liable for the damage it causes. You do have the right to trim the branches of the tree that hangover your property.
