Legal Question in Civil Litigation in California

lien filing

Hi!

I have an agreement with a client to provide services, based on likely lawsuit award that she will be given.

I have a signed agreement. But I would like to ensure receipt of payment, now adding $5000 and growing, by filing a lien against her award.

She knows this and I feel it is just intelligent biz practice to do this.

How may I accomplish this without a lawyer.

There may be issues of enforcability involved. If the "client" has an attorney and that attorney also signs a lien, you have better protections, but that is not a guarantee. The "client" can at any time instruct her attorney to not honor an alleged "invalid" lien. If you can reduce the obligtion from the client to you to a defined sum and have the client agree to enable the payor of the ultimate settlement or judgment to honor the lien, that will hve some teeth. It depends upon the nature of how the debt or lien was created as well. Presently, we have insufficient information to provide a more detailed response.
