Legal Question in Civil Litigation in California

limitation after acciedent law

I am being sued by an insurance company on an accident that happened 3 years ago. At the time of the accident there were no police called nor was a police report filed. What, if any, type of limitations rights do I have?Options?

Re: limitation after acciedent law

I am familiar with this type of lawsuit as i defend many of them for people who dont have insurance. The statute of limitations is 3 years from the date the insurance company made the payment which can be many years after the accident.

Re: limitation after acciedent law

Normally the Statute of Limitations is one year for personal injury.

More information is needed before I can provide any further information.

Re: limitation after acciedent law

Their seem to be a great deal of insurance companies

filing suborgation claims against private individuals.

Another person had a similar problem and I am helping

them out for a nominal fee. What usually happens in

a situation like this the client has no idea that they

can fight the insurance company and so they end

up settling with the insuance company so that they

don't have to deal with a lawsuit. What I do is speak

with the client about their particular situation and then for

a nominal fee I right some nasty letters which usually work to

get the insurance company to go away. This way saves the client

alot of money and hassle since they don't have to deal with the insurance

company themselves. If you are interested in somehting like this

please feel free to contact me I would be happy to give you

a free consultation. My number is 805-546-9918.

I hope to hear from you soon.
